MINI EXCAVATOR RENTAL AGREEMENT

This Mini Excavator Rental Agreement ("Agreement") is made and entered into as of the date signed below by and between Oswego Water Gardens ("Owner") and the undersigned Renter ("Renter").

1. Equipment Rented

Owner agrees to rent to Renter the following equipment:

• Mini Excavator

• Attachments (if applicable)

2. Rental Period & Rate

• Rental Rate: $130 per day, which includes 8 hours of engine use per day.

• Attachments: An additional $20 per day per attachment.

• Overage Hours: Any additional hours beyond 8 per day will be charged at a prorated rate.

• The rental period begins upon pickup or delivery and ends upon return to the Owner (drop-off or pickup).

3. Fuel Requirement

• The machine is provided with a full tank of fuel.

• Renter is required to return the machine with a full tank of 91 octane, ethanol-free fuel (preferred).

• If returned without a full tank, refueling charges will apply.

4. Permitted Use

• The Mini Excavator is to be used only as intended for excavation and related tasks.

• The equipment must remain at the following location during the rental period:

• Renter shall not sublease, lend, or remove the equipment from the listed location.

5. Renter Responsibilities & Damage

• Renter is responsible for any damage to the machine beyond normal wear and tear.

• Any damage incurred must be reported to the Owner immediately.

• The Renter shall not attempt repairs without the Owner's prior approval.

6. GPS & Security

• The machine is equipped with GPS tracking for security and location verification.

• Tampering with, disabling, or removing the GPS unit is strictly prohibited and may result in additional charges or legal action.

7. Indemnification & Liability

• Renter assumes full responsibility for the machine and any injuries, losses, or damages resulting from its use.

• Owner is not liable for any injury, property damage, or consequential damages arising from Renter’s operation of the equipment.

8. Return Conditions

• The machine must be returned in the same condition it was rented, excluding normal wear and tear.

• Late returns may be subject to additional daily rental fees.

9. Payment & Security Deposit

• Payment is due in full prior to rental.

• A security deposit may be required at the discretion of the Owner.

• Any unpaid fees, damages, or refueling costs will be deducted from the deposit or billed separately.

10. Agreement Acceptance

By signing below, Renter acknowledges and agrees to the terms and conditions of this Agreement.
